What is the code for installing an expansion tank on a replacement water heater. Do you have to install one? Or can you just replace it with a new water heater without an expansion tank?

Codes differ from state to state, but the general rule is anytime you have a closed system by the use of a backflow device or PRV, water expansion has no place to go when heated.
Thus, the purpose of the expansion tank. Set the pressure of tank to the working pressure of the home.
