      Polybutelyne was not disclosed when we bought our house and we wound up with approximately $20,000 in damages after a HUGE leak. We are getting ready for mediation with the former owners for non-disclosure. However, my question is, the insurance company paid the property damages (did not pay to have the poly replaced) and have cancelled our insurance because of the claim. Does the insurance company have the right to collect the money they paid us for the damages if we settle in mediation?? HELP!

      Yes, they will want to collect what they have paid out for the damages so it will be necessary to sue them for much more than the $20000.00 since the lawyer will get his cut also.
